  • Market Theatre Laboratory Consent Forms

  • We want to make sure that you participate as a student at the Market Theatre Laboratory with a clear understanding of what behaviour we expect in both the physical and digital spaces we will share. We also want to make sure that you understand and agree or disagree to participate in particular activities at the Market Theatre Laboratory to facilitate the smooth running and success of our programmes.
    To make this easier, we have gathered all the relevant information into this document. This contains:
    1. A release form giving us permission to use your image, as well as audio and video footage.
    2. A permission form giving us permission to add you to a WhatsApp group, as well as guidelines on how to participate
    3. An indemnity form.


    4. An intellectual property form outlining the ownership of the artistic work you make as a student at the Market Theatre Laboratory.
    5. A description of our code of conduct, in particular relating to harassment and sexual harassment, which you must sign to confirm you have read and understood.
    6. Procedures and consequences for missed classes for the course
    7. What happens when a ticket has not been used.
  • STUDENT INFORMATION:

  • I hereby give permission to the Market Theatre Laboratory to use photographic images, audio, and video footage of or by me in its public informational activities and marketing without compensation to me. This could include use in publications, advertising, web pages, social media, video and television. At the discretion of the Market Theatre Laboratory, use could also include making this information or my image available to outside organizations that publish news about the institution, such as newspapers, magazines, news broadcasters and other news organizations. This permission is granted for an indefinite time period.

  • The purpose of the WhatsApp group is to update you regularly on the activities at the institution that are relevant to your course, as well as give you a chance to share information and questions. This form authorizes us to add you to this group. This means that other people in the group will be able to see your cell phone number. We are committed to ensuring that any personal information you provide is handled fairly and confidentially and in accordance with Protection of Personal Information (POPI) legislation. We will not share your cell telephone number with any third party, and it will only be shared with the WhatsApp group.
  • • Respect others as individuals- giving the other person attention, responding politely and not ridiculing what other people say. Remember – not everyone will have the same opinion and that is perfectly OK!

    • Respect other cultures, gender and background

    • Respect others privacy and confidentiality – you must not share contact numbers of participants in the group to anyone else and remember that anything discussed in the group must be treated confidentially.
    • No bullying, harassment or discrimination.
    • No use of explicit / sexual suggestive language.
    • Take turns - let everyone have a turn and do join the conversation when you can.
    • Have Fun!!! share exciting news, share your anxieties and worries, share your thoughts and offer support to one another.
    • Monitoring Policy – a member of the Lab staff will be part of the group chat to both participate and monitor conversations to help and support when required. We may ask you to remove comment or chat that is not appropriate. In rare cases, we may need to remove you from the group.
    • Make a Rule–if you wish a rule to be added here then get in touch and let us know. Speak to your Education Coordinator.
    • Remember – this facility is NOT a replacement for emergency situations. WhatsApp will not be monitored 24/7.
    • All communication may only take place between 07h00 and 19h00.
    • To leave the group: click on the name of the group – this will display the group icon and participants, scroll down to the bottom of the page and click “Exit Group” if you no longer wish to participate.

  • I, the above-named person, being in full capacity, hereby:

    1. indemnify the Market Theatre Foundation and/or its representatives against any claims for losses and /or injuries that may be incurred to me and / or my property while participating in activities organised by and / or presented by the Market Theatre Foundation with the undertaking that the Market Theatre Foundation will take all reasonable measures to ensure my safe participation in its programmes.

    2. understand that the Market Theatre Foundation and/or its representatives will not be liable and / or be responsible for any actions that are caused by my deliberate negligence, use of intoxicating and / or mind-altering substances or breaking of laws, regulation, by-laws and legislation.

    3. understand that my participation in the programmes of the Market Theatre Foundation is strictly according to the rules of the Market Theatre Foundation and that the Market Theatre Foundation reserves the right to terminate my participation if in the opinion of the Market Theatre Foundation my conduct brings disrepute to the integrity of the Market Theatre Foundation.
    In the event of emergencies, the Market Theatre Foundation may contact my next of kin:

  • If you make an original artistic work in your time at the Market Theatre Laboratory, the work is owned by the artists who participated in the making, according to the agreements that exist between these artists. If you perform or show this work outside the Market Theatre Laboratory, the following credit should be included, either in the poster or programme materials: ‘first staged/created at the Market Theatre Laboratory’. Commissioned works: If you participate in an ensemble work created with the guidance of a professional creative team, you have the right to be credited in future marketing material and any subsequent publications as one of the original creators of the work. The Market Theatre Laboratory reserves the right to re-stage the work with a different or smaller cast. Any royalties or profit generated from future productions or publications of the work will go to the Market Theatre Laboratory as the original commissioners and producers of the work.

  • We want to ensure that the Market Theatre Laboratory is a safe, comfortable and positive space for all who experience it. This Code is of Conduct includes important information related to violence and sexual harassment and is informed by the following regulations: Notice 1367 of 1998 of the National Economic Development and Labour Council (NEDLAC), Labour Relations Act 1995, Notice of Code of Good Practice on the Handling of Sexual Harassment Cases.
  • Individuals working, studying or volunteering at the Market Theatre Foundation are expected at all times to:
    - treat one another and the public with dignity and respect
    - act with honesty, integrity and professionalism - avoid conflicts of interest
    - conduct themselves in a manner that reflects positively on the creative industry generally, and particularly, in a manner that does not bring into disrepute to the Market Theatre Foundation
  • Conduct considered unacceptable includes violence and harassment of anyone on the basis of colour, religion, gender, sexual orientation, marital status, national origin, disability, culture, language, ethnicity, age or any other prohibited ground of discrimination recognized in South African law. For the purpose of this Code, “violence” is defined as:
    - the exercise of physical force by a person against another person, that causes or could cause physical injury – or even death – to the person - an attempt to exercise physical force against another person that could cause physical injury or death to the person
    - a statement or behaviour that it is reasonable for a person to interpret as a threat to exercise physical force against the person and that could cause physical injury – and even death – to the person
  • For the purpose of this Code “harassment” is defined as engaging in a course of vexatious/ annoying comment or conduct against a person that is known or ought reasonably to be known to be unwelcome.
    Harassment is characterized by having something said or done to a person that causes distress or discomfort.
    Harassment can include, but is not limited to swearing, teasing, threats, verbal or physical abuse, derogatory comments or jokes, and the display or distribution of derogatory pictures or material.
    Sexual harassment is unwanted conduct of a sexual nature. The unwanted nature of sexual harassment is what distinguishes it from behaviour that is welcome and mutual. Sexual harassment may include, but is not limited to, comments or jokes of a sexual nature, the display or distribution of pornographic material, inappropriate or uninvited touch or contact, sexual advances, requests or pressure for sexual favours whether in return for benefits or not, verbal or physical conduct of a sexual nature, or sexual assault, including rape.
    Sexual attention becomes sexual harassment if the behaviour is persisted in (although a single incident of harassment can constitute sexual harassment) and/or the recipient has made it clear that the behaviour is considered offensive and/or the perpetrator should have known that the behaviour is regarded as unacceptable.
    Quid pro quo harassment occurs when someone undertakes or attempts to influence the process of employment, promotion, training, discipline, dismissal, salary increment or other benefit in exchange for sexual favours.
    Sexual favouritism exists where a person who is in a position of authority rewards those who respond to his/her sexual advances, whilst others who do not submit themselves to sexual advances are denied opportunities, promotions, salary increases or generally, are treated unfairly.
    Sexual harassment may be manifested in interactions between any genders as well as in adult interactions with children
  • Procedures for lodging complaints and reports about unacceptable conduct

    If you believe that you have been subjected to unacceptable conduct or you have witnessed unacceptable conduct, you have the right to report the matter without any fear of persecution, victimization or prejudice.

    All of the Market Theatre Laboratory administrators and education coordinators are aware of the policy and procedures relating to unacceptable conduct, and you can go to anyone you feel comfortable with to ask for advice or clarity.

    Depending on the seriousness of the offence, those against whom the complaint is lodged may be suspended while the investigation takes place, while those found guilty of unacceptable conduct may be given written warnings, be fined, suspended for a period of time, dismissed/expelled and/or have criminal charges laid against them.
  • Regular attendance is crucial for the success and cohesion of our group. We expect all members to actively participate in group activities and attend scheduled classes. This includes showing up for warm-ups before the class starts. To ensure a productive learning environment, the following attendance policy will be enforced:
    6.1 Attendance Requirement:
    • Members are expected to attend all scheduled classes, meetings, warm-ups and group activities.
    6.2 Allowable Absences:
    Members are allowed up to two (2) excused absences per cycle for unforeseen circumstances. Excused absences may include illness, family emergencies, or other crucial valid reasons.

    6.3 Immediate Removal for Excessive Absences: If a member accumulates more than two (2) unexcused absences within a Cycle, they will be subject to immediate removal from the group.

    6.4 Communication of Absences: Members are responsible for notifying the group leader or designated representative in advance if they are unable to attend a scheduled class. In case of unexpected absences, members should communicate as soon as possible.

    Appeals:
    Members who believe they have valid reasons for exceeding the allowable absences may submit an appeal to the group leadership. Appeals will be considered on a case-by-case basis.
    By joining this group, members acknowledge and agree to adhere to the attendance policy outlined above.
    Failure to comply with this attendance policy may result in removal from the group.

  • Please note that once you have purchased a ticket, no refunds will be accepted. In the event that a ticket is purchased, and a serious situation occurs where you are unable to attend the course (Health issues, etc.). An appeal can be made for the ticket to be reused for another cycle. In such cases, the unused ticket may only be rolled over to the next cycle after its original purchase. Failure to use the ticket in time will result to you forfeiting the ticket and purchasing new ticket should you wish to join another cycle of classes.

    Please note: This clause does not apply if you have withdrawn from your classes once the course has started. A new ticket for another cycle will have to be purchased to continue
  • Information contained in or related to reports and complaints under this Code of Conduct shall be treated confidentially and may only be disclosed as necessary for dealing with the matter it concerns, and in accordance with the law.
